Course Objectives The main objective of this course is to examine, in light of relevant judicial decisions, the fundamental principles of usage (gratuitous use) agreements frequently encountered in Turkish judicial practice, as well as the rights and obligations of the parties and the consequences of breach of obligations.
Course Learning Outcomes The students who succeeded in this course;
  • The student who successfully completes this course; 1. Defines the types and general features of utilization contracts. 2. Explains the basic concepts and principles of Turkish lease law. 3. Recognises the distinctions of lease agreements in Turkish (positive) lease law and explains the results of this distinction. 4. Defines the rights and obligations of the parties arising from the lease agreement. 5. Explains the legal possibilities that the parties may apply in case of breach of contract. 6. Explains the basic principles regarding the determination and adaptation of the rental price. 7. Explains the conditions of termination of lease agreements and the procedures related to them. 8. Writes and presents a paper about utilization agreements.
Course Content The aim of this course is to explain the fundamental principles, the rights and obligations of the parties, and the consequences of breach of obligation of utilisation agreements, which are frequently encountered in Turkish legal practice.
