Course Objectives In some situations, people can be responsible to compensate the damage even they do not have any negligence. These people are responsible not for negligence liability, but responsible for absolute liability. Turkish Code of Obligations settled what absolute liability situations are. If these situations are grown, people can be responsible for compensating the damage even they do not have negligence. But in some cases which the damage and the reason of the damage are not related, people can be discharge of compensating the damage. In that lecture, the reasons of absolute liability, the damages by the absolute liability, and the people who will be responsible from the absolute liability will be examined.
Course Learning Outcomes The students who succeeded in this course;
  • Seperate each other defect liability and absolute liability.
  • Solve legal dispute about absolute liability.
  • Criticize legislation about Absolute Liability
  • Offer suggestions for the development of legislation.
  • Give examples about Absolute Liability
Course Content The reasons of liability, liability depends on negligence, the reason why we have absolute liability in our codes, strict liability, different types of damages which must be compensated in absolute liability, people who will compensate for the damage, statute of limitations.
